4.1. Disclosure of sexual harassment is already covered by the existing protection of disclosures showing breach of a legal obligation under whistleblowing legislation, and disclosures of this nature arguably already amount to a protected act under S.27 of the Equality Act 2010. However, the Employment Rights Bill explicitly includes that a disclosure that sexual harassment has occurred or is likely to occur will qualify for protection under whistleblowing legislation.
