The length and extent of any restrictions will depend on the employee’s role. Any restriction has to go no further than necessary to protect the employer’s legitimate business interests. In general terms, the more senior an employee, the more reasonable any restriction is likely to be. Post-termination restrictions can be difficult to rely upon so it is important that the restrictions are bespoke to the individual and carefully drafted and updated if necessary when an employee is promoted or changes roles.
